Outcome of 'mercenary' case fair: ISS Print

The Institute for Security Studies (ISS) described the outcome of the mercenary case as fair, saying the magistrate based his judgement purely on the facts before court. "One must keep in mind that the court was dealing with footsoldiers who on the one hand thought the attempted coup was approved by government and on the other hand a group who thought they were on their way to guard a mine in the DRC," Henry Boshoff of the institute said.
He did however add that it would not be easy for the court to come to another conclusion under the existing Foreign Military Assistance Act. A new act will replace the current one this year. "What the new legislation is trying to do is just to simplify it, but also more in detail spell out what is meant by mercenariers," Boshoff added.

Boshoff also said that this does not mean this court today would have given a different judgement under the new legislation. Meanwhile the National Prosecuting Authority says they will study the judgment and then decide on the way forward.
